Email creation can be a fun and exciting process, with a lot of thought going into layout, content and copy. But how often do you consider the legal information that should be included in your email?
An unsubscribe link is something that is well-known to be a legal requirement in your emails. The CAN-SPAM Act means that recipients of commercial emails must have the option to opt-out. Using a clear unsubscribe link in emails also means that you keep your data clean and avoid being blacklisted if recipients complain because they have been unable to opt-out of your emails.
While most email senders are compliant with unsubscribes, something that is often overlooked is the inclusion of company information in your email. This is a legal requirement, as stated in the Companies Act 1985, which took effect in January 2007 and the Companies (Trading Disclosures) Regulations 2008. These state that “in characters that can be read with the naked eye” the following information must be included:
- Your company’s registered name (e.g. Adestra Ltd)
- Your company registration number;
- Your place of registration (e.g. Scotland or England & Wales); and
- Your registered office address
Not including these can incur a fine of up to £1000 and a further penalty of up to £300 a day for each day these are not added.
